1. Basic Definitions
The OneHeartWeddings website ("Site") is a subscription service that provides downloadable digital media ("Content") and web-based software ("Tools"), for use by its paid subscribers ("Members"). Some new Members may register through a limited free trial ("Trial Period"). The Site and Content are the wholly-owned, copyrighted property of OneHeartWeddings's parent company, Letters and Arts, Inc. ("Company"), and are subject to U.S. and international copyright protection laws. OneHeartWeddings is a trademark of Letters and Arts Inc.
2. Requirement to Be in Good Standing
Usage rights ("Rights") are granted to Members who are in good standing. To be in good standing, one must:
a. Be a past or present account holder with a valid username and password at OneHeartWeddings.
b. Not be using the Content for any illegal or banned purpose.
The Company may revoke privileges to anyone not meeting these requirements or to anyone it believes is abusing the Site, as well as seek legal remedies necessary to protect its copyrights and intellectual property.
3. Free Trial Policies
The Trial Period works like this:
a. One Trial account per person.
b. Registering for the Trial requires a credit card. A small, self-reversing charge (e.g. $1) will be attempted to validate funds.
c. The current trial period is 7 calendar days and subject to change.
d. Downloads are limited during the Trial Period, and the limits are subject to change.
e. Some Content and Tools may not be accessible during a Trial.
f. Trials may not be opened and canceled repeatedly. The full membership fee will be charged for repeated trials.
g. If the Trial Period is completed without cancellation, the regular membership fee will be charged.
4. Free Trial Cancellation
It is the Member's responsibility to cancel the Trial prior to the expiration date shown on the MyHome page. Here's how to cancel:
a. Self-cancel by logging in, going to MyHome, then following the "Cancel My Trial" link in the right-hand margin.
b. If unable to self-cancel, email a cancel request to FreeTrial@OneHeartWeddings.com.
c. If you inadvertently miss the cancellation date and are not satisfied with your membership, we will provide a refund.
5. Subscription Term - Personal Membership
The Personal Membership lasts for 1 year and then the account expires. Members are notified by email when their accounts are about to expire. Automatic renewal can be enabled for Personal subscriptions by logging in, going to MyHome/Account Info, then clicking the link for "Enable Auto Renewal"
6. Subscription Renewals
Membership lasts for 1 year and will not renew automatically. Members are notified by email when their accounts are about to expire. Members may enable automatic renewal by logging in, going to MyHome/Account Info, then clicking the link for "Enable Auto Renewal". If unable, please e-mail a cancel request to service@OneHeartWeddings.com.
7. Personal Usage Rights
All Members are granted a non-exclusive, royalty-free license to use the Content as-is or in modified form for personal purposes. Personal purposes may include all personal printing uses, email, personal websites,scrapbooks and crafts of all kinds, so long as none of these uses are for commercial gain or general distribution.
8. General Content Restrictions
The following content uses are not permitted for ANY member:
a. Any form that competes with OneHeartWeddings or Letters and Arts, Inc.
b. Resold or distributed in its original form, or a form that might be confused with the Content.
c. Published on commercial websites that display advertising to generate revenue, including YouTube and others.
d. Used in print runs that exceed 50,000 printed pieces without written permission from the Company.
9. Site Usage Rights
All Members may use the Site to browse, search, and download Content at any time during their period of active membership. Limited search and browse is also available to prospective members. Crawlers, spiders, programmable scripts or other automated technologies may not be used to browse, search or download images.Downloads may not be in excess of 100 images per day per Member.
10. Limited Commercial Rights
Members who purchase or upgrade to a 1 year Professional Membership are granted a non-exclusive license to use the Content for commercial gain during the term of the purchased subscription, subject to the Commercial Rights Restrictions as well as the General Content Restrictions.
Examples of acceptable commercial, made-for-resale uses include:
a. Use by wedding planners in developing materials for clients.
b. Use in pre-printed wedding invitations, programs, shower invitations and other pre-printed stationery.
c. Use in embroidery patterns, candy wrappers, wrapping papers, calendars, and all professional craft applications.
d. Use in business promotion, including letterhead, business cards,presentations, company logos, and company websites.
e. Use in wedding video productions.
11. Commercial Rights Restrictions
Professional Users must be fully paid subscribers before Commercial Rights apply. Also, the following commercial uses are not permitted except by separate written agreement with Letters and Arts, Inc.:
a. Anything that violates our General Content Restrictions.
b. All commercial television.
c. Print distribution over 50,000 printed pieces.
d. All commercial cell phone or wireless device uses.
12. Professional Subscription Renewals
The One Heart Wedding's Professional Membership subscription period is one year. To ensure uninterrupted member access, subscriptions automatically renew upon expiration and the professional membership fee will be charged to your credit card. Advance e-mail notices are sent, as well as receipts for a successful renewal. To disable Auto-Renewal:
a. Self-disable by logging in, going to MyHome/Account Info, then click the link for "Disable Auto Renewal"

13. Rights and Access Privileges Do Not Transfer
One Heart Weddings Members are not allowed to transfer, share, trade, or sell their membership Rights unless by express written permission of Letters and Arts, Inc. Each membership shall be uniquely associated with one person and that person alone shall have Site access rights.
14. LIMITATION OF WARRANTY AND LIABILITY
LETTERS AND ARTS, INC. MAKES NO WARRANTIES AS TO THE FITNESS,CORRECTNESS, RELIABILITY, OR MERCHANTABILITY OF THE CONTENT OR SITE FOR A PARTICULAR PURPOSE. LETTERS AND ARTS INC. PROVIDES NO ASSURANCES OR WARRANTIES THAT THE SITE OR CONTENT WILL BE FREE FROM ERRORS, OMISSIONS, INCOMPATIBILITIES, INTERRUPTIONS, OR VIRUSES OR OTHER RISKS COMMONLY ASSOCIATED WITH THE USE OF COMPUTERS, SOFTWARE OR THE INTERNET. LETTERS AND ARTS INC. HAS NO OBLIGATION TO SERVICE OR REMEDY ANY ASPECT OF THE SITE OR THE CONTENT; AND HAS NO OBLIGATION TO ASSUME THE COSTS OF REPAIRS OR SERVICE TO USERS' HARDWARE, SOFTWARE, OR OTHER EQUIPMENT IN THE EVENT OF ANY CLAIMS OF DAMAGES.
IN NO EVENT WILL LETTERS AND ARTS INC., ITS OFFICERS, DIRECTORS,AFFILIATES, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, SPECIAL,INCIDENTAL, ECONOMIC, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SITE OR CONTENT, EVEN IF LETTERS AND ARTS,INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ALL CLAIMS RELATED TO THESE USAGE TERMS SHALL BE HEARD IN THE COUNTY OF JACKSON AND WILL BE GOVERNED BY THE LAWS OF THE STATE OF OREGON.
